 Melissa A. Pasek, Partner Melissa Pasek is a Partner of Flynn Riley Bailey & Pasek LLP. Ms. Pasek has spent her entire 24 year career representing exclusively single family homeowners and homeowners' associations throughout Northern California in both general corporate matters and construction defect litigation.

Ms. Pasek has particular expertise in the analysis and interpretation of SB800, the Builders Right to Repair Law. Ms. Pasek also represents community associations in their day to day operations and transactional matters. She has extensive experience in working with community associations, their Board of Directors, and managers in complying with the Davis-Stirling Act and related California law. Ms. Pasek advises common interest developments on general corporate matters including governing document analysis and interpretation, compliance with Association's maintenance and repair obligations, and compliance with SB800 Maintenance Manuals and Inspections.

As a litigation partner, Ms. Pasek represents homeowners association's in the SB800 Claims Process as well as construction defect litigation. Ms. Pasek created and developed a SB800 Pre-Litigation Claims Process which has been a highly successful tool in allowing the firm to resolve the majority of its construction defect matters without the filing of formal litigation in Court. Ms. Pasek has contributed to the successful resolution of many complex construction defect cases and recovered millions of dollars for the firm's clients.

In addition, during the course of any Association claims or litigation process, Ms. Pasek assists Association management in the communications process with the Board of Directors and Association membership including drafting monthly status reports to Boards as well as quarterly real estate disclosure to the Association membership. Effective communication is the cornerstone of the firm's relationship with its clients.
